Eligibility for Supplemental Job Displacement Benefits

You may qualify for these benefits if:

  • Your work-related injury or illness occurred on or after January 1, 2004.
  • You can’t return to your former job due to permanent disability and work limitations.
  • Your employer cannot offer you suitable alternative work.

Alternative Work Criteria:

  • You can perform the essential job functions.
  • The job is non-temporary and will last at least 12 months.
  • Your wages will be at least 85% of what they were at the time of your injury.
  • The job is within a reasonable commuting distance from your residence at the time of your injury.

If the alternative work offer meets these criteria and you reject it, you will not be entitled to supplemental job displacement benefits. If the offer doesn’t meet these criteria, you may still be eligible but might need to challenge the decision by filing a “Request for Dispute Resolution” with the Division of Workers’ Compensation. Benefits Are Paid as Vouchers

Supplemental job displacement benefits are provided in the form of non-transferable vouchers, which can be used for:

  • Educational training, skill enhancement, and vocational education at state-approved or accredited schools.
  • Up to 10% of the voucher’s value for vocational or return-to-work counseling.
  • Out-of-state schools approved by a system similar to California’s.

Voucher Value Based on Injury Date:

  • Before January 1, 2013:
    • Less than 15% disability rating: $4,000 voucher
    • 15% to 25% disability rating: $6,000 voucher
    • 26% to 49% disability rating: $8,000 voucher
    • 50% to 99% disability rating: $10,000 voucher
  • On or after January 1, 2013: A $6,000 voucher regardless of disability level.
